Exclusive Use Not Offered
Due to the nature of licensing under the DK FAMNA License and the availability of free downloads, my tracks are not available for exclusive licensing. However, I am open to discussing potential custom projects tailored to your needs. Please note that such projects will incur fees and will not be free.
I reserve the right to determine whether a custom project aligns with my interests and creative vision and may decline requests at my discretion.
Disclaimer About Royalty-Free Music
Whilst my music is free to download and use in your projects, please be aware that in some instances, performance rights and sync licensing organizations may detect and collect royalties. These collections can sometimes be out of my control. However, this does not mean you have to pay any of these royalties directly as a content creator or user.
Disclaimer About Content ID Claims
I use Content ID and similar music detection services to track usage for some of my music, but this does not prevent monetisation of your videos. If a Content ID claim is triggered:
- It is to track usage, not to block monetisation.
- If you encounter an issue, appeal with proof of proper attribution, and/or contact me for assistance.
Encouragement for Sharing the Music
If you enjoy my music, feel free to share this site with other creators or recommend it for their projects. Please ensure they follow the same attribution guidelines.
Minor Modifications / No Derivatives
Minor modifications are allowed, such as trimming portions of the track to align it with your video or project. However, full remixes or sampling the track for use in other compositions are not allowed. You cannot create new music using my music.
An adaptation (or derivative work) happens when you modify or build upon someone else’s music. Examples include:
- Remixing: Changing the arrangement, adding new beats, or combining parts of the song with other elements.
- Covering a song in a way that transforms it significantly (e.g., altering the melody, structure, or lyrics beyond simple performance).
- Sampling: Using parts of the original music to create a new track.
- Translating lyrics into another language while performing the song.
Some uses of music are not considered adaptations, such as:
- Playing or performing the song as-is: Simply covering a song without making significant changes (e.g., singing it with the same melody and structure) is not an adaptation.
- Format-shifting: Converting the music file to a different format (e.g., MP3 to WAV or MIDI) without altering its content.
- Reusing the track in unaltered form: Embedding or including the original track without any modifications (e.g., using the song as background music in a video without changes).
If the song is under a No Derivatives license, you cannot share or distribute modified versions (e.g., remixes, sampled tracks) without explicit permission.
Copyright Notice
All music is owned and produced by Daniel Kemble. While my tracks are free to use under the specified terms, they are not exactly copyright-free and cannot be redistributed as your own.
What You CANNOT Do:
- Claim the music as your own.
- Remix or alter the music to create new music.
- Use the music as background for your own compositions without my approval.
- Register the music on any distribution platform (e.g., Spotify, iTunes) or copyright detection system. This will be flagged if attempted.
- Sell or redistribute the music.
- Use the music without attribution in titles, descriptions or credits.
- Modify the credits (e.g., adding or removing information).
- Use unauthorized download methods—always use official download links.
Failure to adhere to these terms may result in takedowns or legal action. These issues will likely be flagged by other distributors and music detection services that I am associated with to ensure proper accordance to these rules.
